Términos y condiciones generales

These terms and conditions intend to clarify certain aspects of the booking process and to protect all parties, setting out a clear understanding of contractual obligations of both the client and hotel when confirming a booking. We have tried to make them as straightforward as possible; if, however, you have any questions please feel free to speak to us before agreeing.

Definitions

“Company” or “we” means Astley Bank Hotel (Company Registration Number 03353389), VAT Registration number 237553789.

“Booking” or “Reservation” means the booking for accommodation, restaurant or other functions not including Weddings

“Contract” means the Booking and these Terms, and any other terms and conditions stated to apply to the Booking.

“Hotel” means the premises for which your Booking is made.

“Terms” means these terms and conditions.

“Website” means https://www.astleybankhotel.co.uk/

“VAT” means value added tax.

Introduction

The Company enters into this Agreement as principal for Bookings made for the Hotel. These terms and conditions apply when you reserve a room at the Astley Bank hotel.

We reserve the right to amend these terms and conditions at any time and you should therefore check them each time you make a reservation.  The terms and conditions that apply to your reservation will be those in place on the date that you make your reservation.

Additional terms apply if you use one of our other digital channels (Eg. Booking.com) whether or not you make a reservation through them. These are published on the relevant digital channel.

Reservations

You must be at least 16 years old to make an accommodation reservation.

You will need to provide your credit or debit card details to secure your reservation.

At the time of Booking or at check-in, we will take your credit/debit card details and you authorise the use of this card for any sums that become owing to us. We shall also have the right to require full payment in advance or a deposit at the time of Booking in certain circumstances (advance purchase rate for example) or if the Booking includes the supply of certain items or services. No Booking shall be treated as confirmed until the details and/or payment/deposit described in this paragraph have been provided.

Group Reservations

Una reserva de cinco habitaciones o más se considera generalmente una reserva de grupo dentro de Astley Bank.

Charges

Astley Bank adopta precios dinámicos y el precio de nuestras habitaciones varía según la demanda y las tarifas especiales.  Cuando realice una solicitud de reserva, le daremos un precio total por las habitaciones y el número de noches que ha solicitado. El precio que pagas es el precio que te cotizan en el momento de realizar tu reserva.

The prices displayed on the Website are an average per night per room until a rate is selected. Any meals, service or VAT (at the prevailing rate) are included only if specified. A minimum length of stay, deposit, cancellation charge and other conditions may apply to certain rates, as specified. Once a rate is selected on the

Website, the total for your requested stay shall be displayed on the reservation summary. Prices shall be charged in the local currency of the Hotel.

Price lists for additional items, such as restaurant meals and room service, are on display at relevant locations within the Hotel and are available on request.

Payment

We accept the following methods of payment:
  • Credit cards: American Express, MasterCard, Visa
  • Debit cards: Visa/Delta, Visa/Electron, MasterCard, and Maestro.
We DO NOT accept cheques.

At the time of check-in, we will process the accommodation charges (room rate, VAT and any service charge) for the duration of your stay against your credit/debit card. You will need to insert your card PIN for the transaction to go ahead.

The expiry date of your debit/credit card must be later than the end of your stay.

All outstanding charges must be paid for in full on check-out from the Hotel. If staying for multiple nights at the Hotel we may require you to make payment for any outstanding charges on a more frequent basis during your stay.

Occupancy

La ocupación máxima de la habitación es de dos adultos.  Las habitaciones familiares (donde estén disponibles) pueden acomodar a dos adultos y dos niños (menores de 16 años). No debe exceder la ocupación máxima de la habitación asignada a usted.

Children under 16 are not permitted to stay in Astley Bank unless a parent or guardian is also staying in the hotel.

Arrival and Departure

Rooms are available from 3 pm on the arrival date. Please let Astley Bank know if you are likely to arrive after 11 pm.

Guests will be asked to complete a registration form and provide proof of identity upon check-in. Overseas guests, excluding Republic of Ireland and Commonwealth citizens, will be asked to complete a registration form and provide their identity card/passport details. Acceptable forms of identification are a passport, driving license, ID card or police warrant card.

Rooms must be vacated by 11 am on the day of departure. Failure to leave your room by this time will result in a late check-out charge.

Special Requests

Meals

Breakfast is included in some room prices. You may add breakfast and/or a meal deal (where available) when you make your reservation.

Your Right to Cancel

All room reservations, apart from advance purchase rate, may be cancelled up to 24 hours prior to the room check-in time on the arrival date. A cancellation reference will be given and should be retained as proof of cancellation. All advance purchase rate room bookings are non-amendable and non-refundable.

If you decide to shorten your stay you must inform reception at the hotel by 12 noon on the day you wish to check out. Otherwise, you will be charged a cancellation charge equivalent to one night’s accommodation per room booked and for any meals and other extras booked for the following day.

Your Right to Cancel – Group Bookings

Our Right to Cancel

Very occasionally we may need to cancel your Booking. Depending on the circumstances of the cancellation, you might be given a full refund, but we shall have no further liability to you arising out of such cancellation. We will, however, use reasonable endeavours to try and relocate any confirmed Booking cancelled by us to an alternative location similar in standard to the Hotel.

Podemos cancelar su reservación en cualquier momento con efecto inmediato al darle un aviso por escrito (que incluye el correo electrónico) si:
  • You do not pay us when you are required to do so; or
  • You break the contract between us in any other material way.

Events Outside our Control

We may also cancel your reservation if an event outside of our control (including industrial action, lockdown, explosion, fire, flooding, and failure of power and/or water supplies or emergency evacuation) means that we are unable to make your room available to you. In this case, we will contact you to let you know as soon as possible and:
  • If you have already paid for your room, we will refund your payment to you; or
  • If you have not yet paid for your room, you will not have to make any payment to us.
Same as set out above, we will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by an event outside of our control.

Damage

We reserve the right and you hereby authorise us to charge your credit or debit card for any damage incurred to your room or the Hotel during your stay (including without limitation specialist cleaning) or for any items that are missing when you leave.

Evacuation

In event of a fire alarm, please vacate the venue immediately and gather at the fire assembly area, located at the car park. Leave all belongings behind and do not re-enter the building until you are told by a safety Marshall to do so.

Hotel Events

Please be aware that at certain times throughout the year our Hotel may host weddings, events and parties, which you may feel would be an intrusion on your break. Please contact the Hotel directly in advance of your stay for further information.

Comportamiento del huésped

Guests are requested to conduct themselves appropriately at all times and to comply with Company procedures and/or requests with regard to conduct and respect for the property of the Hotel, its employees and guests and their health and safety. Guests are requested not to disrupt the comfort and enjoyment of other guests, the smooth running of the Hotel, or cause offence to other guests or our members of staff. We reserve the right to refuse accommodation or services or remove you and members of your party from the Hotel if, in our reasonable opinion, we consider this provision to have been breached. Where this is the case we shall have no obligation to refund you for lost accommodation, other services or any other loss or expense incurred.

Astley Bank Expectations of You (and Your Group)

We request that you not:
  • Smoke anywhere inside any Astley Bank premises. This includes the smoking of e-cigarettes. The only permitted smoking area is located in the Smoking Garden and other outside designated areas. There are no Smoking areas within the Astley Bank Hotel Building. Smoking on Astley Bank premises outside of the designated smoking area will result in a £100 fine;
  • Bring any pets onto Astley Bank premises, with the exception of assistance dogs;
  • Bring any potentially dangerous or hazardous materials or equipment onto Astley Bank premises;
  • Use any electrical appliances that may set off the fire alarm system, such as toasters, mini cookers or portable grills;
  • Tamper with any fire alarms or emergency equipment;
  • Remove, damage or destroy any Astley Bank property;
  • Use any of the technology provided by Astley Bank to download or access any unlawful or obscene material; or
  • Cause unreasonable disturbance to our other guests or any Astley Bank staff.
Si usted o su grupo causan daños o pérdida de cualquier tipo en el Hotel, otros huéspedes o su propiedad, usted (como la persona que hace la reserva) será responsable de ese daño o pérdida y usted será responsable de pagar a Astley Bank a petición la cantidad requerida para hacer el bien o remediar tales daños o pérdidas.

Usted y los miembros de su grupo no deben revender o transferir su reservación (o cualquier parte de ella) ni anunciar el mercado o de otra manera ofrecer cualquier habitación de Astley Bank a la venta, ya sea por cuenta propia o como parte de una oferta combinada. If you or your group cause damage to the hotel, other guests or their property, or otherwise breach any of these terms and conditions, Astley Bank will not be liable for any refund or compensation and reserves the right to:
Cancel your reservation with immediate effect and (if appropriate) eject you from Astley Bank premises;

Retain all sums paid by you and/or charge you the full amount of your reservation; and/or

Refuse future reservations from you and/or refuse you entry or accommodation at any of our hotels.

Your Information

Parking

All customers and guests have access to free parking on our private car park. There is disabled parking available at the front of the hotel, which is accessible to blue badge holders. Should a badge not be displayed, a fine of £100 will be charged.

Private Dinning

Private dining is available at a small room hire cost (please contact for information). Please note that on Sundays a three-hour time slot applies, and you cannot have use of the private room for longer than that.

Our Liability

Aceptamos responsabilidad por muerte y lesiones personales derivadas de nuestra negligencia o la de nuestros empleados y agentes. No buscamos excluir nuestra responsabilidad por tergiversación fraudulenta por nosotros o nuestros empleados o agentes.
No aceptamos responsabilidad por incumplimiento de cualquiera de nuestras obligaciones cuando dicho incumplimiento se deba a eventos que superen nuestro control razonable.
Si violamos estos términos y condiciones por razones bajo nuestro control, solo seremos responsables de las pérdidas que sean pérdidas directas y una consecuencia razonablemente previsible de dicha infracción.
No seremos responsables de si en contrato, agravio (incluyendo negligencia) o por incumplimiento de deber estatutario o de cualquier otra manera, por cualquier pérdida indirecta o consecuente, incluyendo:
  • Loss of income, sales or revenue;
  • Loss of business;
  • Business interruption;
  • Loss of profits or contracts;
  • Loss of anticipated savings;
  • Loss of data;
  • Loss of reputation and/or goodwill; or
  • Wasted management or office time.

Applicable Law

Estos términos y condiciones, su materia y formación (y cualquier disputa o reclamo no contractual) se rigen e interpretan de acuerdo con la ley inglesa.

If you are a consumer you and we both agree that the courts of England and Wales will have non-exclusive jurisdiction over any claim arising from or related to, your reservation and/or stay at any Astley Bank hotels. We retain the right to bring proceedings against you for breach of these terms and conditions in your country of residence or any other relevant country. If you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident in Scotland, you may also bring proceedings in Scotland. If you are making a business reservation, you and we agree that the courts of England and Wales will have exclusive jurisdiction over any claim arising from, or related to your reservation and/or stay at any Astley Bank Hotel.

Severability

If any part of these terms and conditions is deemed invalid, illegal or for any reason unenforceable then that part will be deemed deleted and will not affect the validity and enforceability of the remaining parts. Any failure by us to enforce our rights or remedies under these terms and conditions or otherwise shall not be construed as a waiver by us of those or any other rights or remedies. All rights not expressly granted in these terms and conditions are reserved.
